Question by Kovie: Is it legal to have the same name as another company?
I’m starting a small film production company and came up with the name Red Sky Productions. I plan on expanding it as I get older, more involved, and meet more filmmakers like myself. I had a friend make me a logo and everything. It’s really cool. Last week my sister told me that there was already a production company with that name. I looked it up and sure enough there was. And, of course they’re a bigger company than I am. Do I have to come up with a different name or is it okay to keep it?

If the name is trademarked, and an established company in Los Angeles surely would be, then you can not use their name. If you plan to grow and be known in the film industry they are going to end up demanding you cease using their name. It’s better to start with a clean slate, be able to have the domain name, and be original. Being original in the arts production field is essential.
Next name … do a search of the domain name and on google before having a logo developed.
