When the Producer/Investor buy the right to portray someone in a film or television program the Producer/Investor buy a “bundle of legal rights”. These rights include protection from suits based on defamation, invasion of privacy and the right to publicity.

The Producer/Investor may also be seeking the cooperation of the principle, her/his family, access to friends and relatives or heirs and successors. The Producer/Investor will desire access to a personal and private facts/diaries that would not otherwise be available to the general public.

The Producer/Investor should always consider the possibility of fictionalizing the story. The Producer/Investor might consider changing the names of the individuals involved, the location and alterations so that the depiction release is not necessary.

This Agreement between the Depicted Person and the Producer is drafted in plain English that is easy to read and comprehend. This is a four page, fourteen clause legal Agreement. The Agreement may be filled in on your computer or printed out and filled in later.

Herein this Agreement the Independent Filmmaker is called the “Producer”.

1. The Depicted Person, named above and signed below, understands that the above named and below signed Producer(s) desires to use all or parts of the events of the Depicted Person’s life in order to have one or more teleplays or screenplays written, or documentary made, and to produce, distribute, exhibit and exploit one or more television programs and/or motion pictures or documentary of any length in any media now known or hereafter devised and sound recordings in any media now known or hereafter devised. The Depicted Person has agreed to grant the Producer certain Rights in that connection. This Consent and Release confirms our agreement as follows:

In consideration of the Producer’s efforts to produce my story, the Depicted Person, payment to me of: _________, upon the beginning of principal photography of a full-length feature film, and/or _______ upon the beginning of production of a television movie, and/or ________upon the beginning of production of a pilot program and a royalty of _________ for each episode, and _________ and or beginning of a documentary for other valuable consideration, with full knowledge the Depicted Person hereby grants the Producer, perpetually and irrevocably, the unconditional and exclusive Right throughout the world to use, simulate and portray the Depicted Person’s name, likeness, voice, personality, personal identification and personal experiences, incidents, situations and events which heretofore occurred or hereafter occur (in whole or in part) based upon or taken from the Depicted Person’s life or otherwise in and in connection with motion pictures, sound recordings, publications and any other media of any nature at all, whether now known or hereafter devised.

3. Without limiting the generality of the foregoing, it is understood and agreed that said exclusive Right includes theatrical, television, dramatic stage, radio, Internet, cell phone, satellite transmission, cable distribution, sound recording, music, publishing, commercial tie-up, merchandising, advertising and publicity rights in all media of every nature whatsoever, whether now known or
