Question by magitha: If I am making a documentary for a film festival, will it still be for educational purposes?
I know if a documentary is made for money it is not for educational purposes. But would this be different if its for a film festival? Even if it isn’t for educational purposes, fair use still applies, right? Would the fair use guidelines switch whether its educational or not?

It doesn’t matter where you exhibit the film. What matters is how you use the material for which you’re claiming fair use. Check out the Documentary Filmmakers’ Statement of Best Practices in Fair Use:

This has become the industry standard.
