Is it legal to use identifiable footage of people in a private home under the influence of alcohol in a documentary without their consent? are their any laws that require a release form to be signed? If this doesn’t happen what are the possible legal consequences? Note that this is in Australia.

If its from a hidden camera – I think there could be a problem, but if the camera was in plain view ten no, the people saw the camera, they knew they were being filmed. Whether it appears on YouTube or Channel 9 makes no difference.
