Question by questionman: Star in and produce an adult film! – A prostitution loophole?
What if a pimp with a camcorder solicited a man on a street corner to star in and ‘produce’ an adult film? Of course, production would just be a cheap dvd burner and a label maker and possibly some token distribution, but will this get around the prostitution law since they are having sex for business, not pleasure? To put it in another way, the man is still paying for sex, but if he pays for ‘production costs’, will those production costs be considered a loophole?

Nope the court will look at what the money was really for. It’s just like the old scam for ticket scalpers trying to get around the law. You’d pay to buy an “envelope,” but in the envelope happened to be tickets. The courts found that a person obviously isn’t paying $ 400 for an envelope, but for the tickets inside. Also in most states adult film making is heavily regulated, so unless all those regulations where complied with there would be zero chance. (Even Girls Gone Wild, etc type productions have to comply with laws regarding information on actors/actresses, where the information is filed (and it’s generally PUBLIC information), consents, and much more)
