Well in story telling there are some ridiculously overused literary devices that audiences are used to seeing. So to retell the same story yet again changing only the names and faces is a very safe and uninteresting decision. Such might not be considered art because of a lack of originality.
That lack of originality might be seen in the way the film is shot or the way the roles are acted.
Some movies besides lacking originality, also may lack skill. An unexperienced film maker will scarcely have the ability to get coverage of his scenes. Simply pointing the camera without concept of visual technique or photographic experience will create a shoddy final product.
All films are in a sense art. But there is bad art and there is good art. Just like there is bad construction and good construction. If you have 2 houses, and one was built by a master builder with 20 years experience and an ample budget, but the other one was put together by a total moron who was underfunded and blind to his own mistakes – well which house is going to be good and which is going to be bad????
