When a record company has exclusivity over your musical work, in a music contract, this means that you can only record for the label you are signed to for the term, (length) of the music contract.
However, you need to also realise that many music contracts have a re-recording restriction. This basically prevents you from recording any of the material you have recorded for your previous record company for a period of two years or more following the end of the term of the contract. Also, the contract could state that you cannot record for any other company for five years after the contractually agreed submission date of your album to the record company you signed to. Either the two-year or five year stipulation will apply depending on which one is longer.
Obviously, you should endeavour to work around this exclusivity restriction. Two ways you might do this is to negotiate for the right to perform on another artist’s album as a sideman. Also, having your music contract allow another record company to release your work to be included in a soundtrack to a motion picture. There are a myriad of examples of this such as the film Top Gun or Pretty Woman. It is very important that you are aware of these music contract exclusivity options.
This is because a record company is unlikely to offer a non-exclusive deal. This would give you the right to work with any other artist or company. Interestingly, online distributors such as the Orchard do claim non-exclusivity in their music contract. Be warned though, the contract is very complicated to understand without professional help. Other retail sights such as Amazon for example allow you to freely sell your music through their mp3 download site. In this case, there are no exclusive rights being gained by Amazon. It will be interesting to see how these changes will affect traditional record company contracts. However, as always, seek professional advice before you ever sign a music contract.

More recently, he has been working with an independent record company named In4rm Records who have a distribution deal with the main distributor of digitally based independent music called The Orchard based in the US. He has an EP out called Wired by Liteform with two other artists, which is in the underground dance Genre. It is currently available on most of the download sites to be purchased such as MSN Music, Amazon.com and iTunes etc. He is getting airplay on the Internet on The Pod Safe Music Network for many of his other productions as well.

Question by spittonastranger: what is the usual percentage a producer gets in royalties in a standard music contract?
my producer and i are working on my demo, and he wants me to sign a contract saying that when my demo is released and if i receive any royalties that he receives 50% for the taking..that seems a bit much..i was wondering what the standard percentage is for a producer to receive ,cause i was thinking more along the lines of 30%.

You’re right. He is asking a bit much. But it’s also pretty normal. The trick is to have a good manager or agent. Someone to do your negotiating for you.
In my company we feel 25 – 30% is more than fair compensation. We also get front end reimbursement for expenses so we don’t get burned. Usually everyone comes out of the deal happy.
Try not to sign a contract you’ll want to repudiate 3 years later. MANY artists wind up working for the company until they decide to go bankrupt.
